If, while using or visiting eMastered (the “Service”), you believe that content accessible on or through our platform infringes your copyright, you may notify our Designated DMCA Agent by sending an email to support@emastered.com with the subject line “Copyright Claim.” Please note that eMastered’s designated DMCA Agent for notice of alleged copyright infringement can be reached at this email address. If you require a mailing address or additional contact information for our DMCA Agent, please request it in your initial communication.

Before sending such an email, please keep the following in mind:

  • Eligibility to File a Claim: You may only submit a copyright claim if (a) you are the owner of the copyrighted material in question, or (b) you are legally authorized to act on behalf of the copyright owner’s interests. If you are not sure whether you have the right to file a claim, please seek legal advice before proceeding.
  • Identification of Infringing Material: Your email must clearly identify the allegedly infringing material, including a hyperlink (URL) where the infringement is located. General descriptions without a valid URL or specific identifying information may not be sufficient for us to locate and address the infringement.
  • Evidence and Information Required: Please provide sufficient evidence and information demonstrating that the content at issue infringes upon a valid copyright. Your notice should include:
    • A clear description of the original copyrighted work (or a representative list of such works) claimed to have been infringed.
    • Proof of ownership or a statement explaining your authority to act on behalf of the copyright owner.
    • Your full legal name, mailing address, telephone number, and an email address at which you can be contacted.
    • A statement under penalty of perjury that you have a good-faith belief that the use of the copyrighted material is not authorized by the copyright owner, its agent, or the law.
    • A statement, under penalty of perjury, that the information in your notice is accurate, and that you are the copyright owner or authorized to act on the owner’s behalf.
    • An electronic or physical signature of the copyright owner or the person authorized to act on the owner’s behalf.
  • Prohibition of False or Malicious Claims: Submitting false, malicious, or intentionally misleading copyright claims is illegal and may lead to legal action. Any user who submits such claims will have their account suspended or terminated, and we may seek all remedies available under the law.
  • Responsibility for Damages: Should damages (including legal fees or other costs) arise out of a false, malicious, or otherwise unjustified copyright claim that affects eMastered, the party who submitted the incorrect claim will be held directly responsible for all charges and fees incurred by eMastered in resolving any resulting damages.

Processing of Claims and Counter-Notices:

We will review and respond to proper DMCA notices within a reasonable timeframe, as required by applicable law. If we remove or disable access to content in response to a DMCA notice, we will take reasonable steps to notify the user who posted the content. If that user believes the removal was made in error, they may file a counter-notice pursuant to the DMCA. Instructions for filing a counter-notice will be provided to the affected user at that time. Upon receipt of a valid counter-notice, we may restore the material in question unless the original complainant files an action seeking a court order to restrain the alleged infringement.
